General risk disclosure statement

PLEASE READ THIS RISK DISCLOSURE STATEMENT CAREFULLY

The use of the App, its Content, the Services and the Outputs (as defined by the Terms and Conditions) requires you as the User (as defined in the Terms and Conditions) to acknowledge and agree the following, which does not replace or limit the Terms and Conditions and/or the Privacy Notice and/or the Transparency Notice, all of which apply to the User and to the use of the App, its Content, the Services and the Outputs in addition and/or as an integration of the below.

1. Users risks and personal own judgements

The Users acknowledges and agree that:

  • trading and investing in financial markets, including stocks, derivatives, currencies, commodities, and virtual assets, carries a high level of risk;
  • before engaging in any trading or investing activity, the User shall carefully consider his/her financial situation, shall always carefully consider whether a particular product or service is consistent with his/her risk tolerance, investment objectives, investment experience or sophistication, financial condition, financial needs, personal circumstances and other considerations that may be relevant to him/her;
  • the User shall seek advice from an independent professional adviser before deciding whether to invest in, hold or dispose of any investment or to enter into any product agreement or service agreement;
  • the App is a behavioural and psychological coaching tool; accordingly, the App is not a risk management system, a trade management tool, or a financial advisory service;
  • using the App does not, among the others,:
    • reduce the inherent risk of trading or investing
    • protect from financial loss
    • guarantee better outcomes
    • constitute a risk management strategy for trading activity
    • replace the need for your own risk management processes and controls;
  • the App is designed to support improved trading discipline, better habits, and more consistent decision-making, with no guarantee of any specific financial, trading, or psychological outcome. Results will vary between users and depend entirely on the User's own effort, consistency, and application of the coaching provided.

In addition to the above, the User acknowledges and agrees that any and all the Services and the Outputs including those that might make reference to trading plan, open positions, emotional state, or market behaviour – are only a behavioural coaching output and based solely on the information the User has provided. It is so acknowledged and agreed by the User that the App, its Content, the Services and the Outputs are not:

  • a risk assessment of current position or portfolio;
  • a recommendation to reduce, increase, hedge, or close any position;
  • an assessment of any trade or strategy for your circumstances; and
  • professional financial, investment, or risk management advice

The User is solely responsible for his/her own risk management. The App, its Content, the Services and the Outputs must never be used as a substitute for risk controls, stop losses, position sizing rules, or other risk management measures.

2. Connected trading account

Subject to the above, it is acknowledged and agreed by the User that the use of the App and/or its Content and/or the Services and/or the Outputs do not require at any purpose and time the connection to the App of a trading account.

Accordingly, the User acknowledges and agrees that in case the User decides, at his/her own discretion and risk, to connect a trading account or platform to the App, :

  • such connection of a trading account is entirely optional and made at his/her own discretion and risk, with no responsibility in any events and for any reason whatsoever by the Company;
  • the App can only read data from the connected account, including trade history, open positions, account balances, and market data;
  • the App shall not place, modify, cancel, or otherwise interact with any trade or order on the account;
  • the User only shall be responsible for any trading activity on the connected account at all times
  • the Company is not liable, among others, for any loss arising from the User sole decision to connect or disconnect a trading account, or from any data read from a connected account.

The User may disconnect the trading account at any time through the account settings or by contacting us at info@wendyai.bot.

3. Market data

The User acknowledges and agrees that the App can have access to market data only if provided by the User or through a connected account.

Subject to the above, the User acknowledges and agrees that in the above events:

  • the market data can be used by the App solely to provide contextual coaching support;
  • the Company does not warrant the accuracy, completeness, or timeliness of any market data;
  • market data must not be relied upon as the basis for any trading or investment decision, being the User responsible for independently verifying any market information before acting on it.

4. AI limitations and coaching risk

The Services and the Outputs are generated automatically by an AI system. As set out in the Terms and Conditions and/or in the Transparency Notice, the User acknowledges and agrees that the App may produce responses that are incomplete, inaccurate, misleading, or not suited to User’s specific circumstances.

In addition to the above, the User acknowledges and agrees that there is an inherent risk that the use of the App, its Content, the Services and the Outputs may influence thinking, confidence, or decision-making. However, the User acknowledges and agrees that:

  • any such influence is the result of his/her own interpretation of the use of the App, its Content, the Services and the Outputs
  • the Company is not responsible for the interpretation and/or the use and/or the decision made by the User;
  • the use of the App, its Content, the Services and the Outputs do not guarantee improved trading outcomes
  • the User shall make any decision at their own discretion and only on the basis of their own independent judgment.
  • the User must not interpret confidence, certainty, urgency, or decisiveness in the App's language, Services, or Outputs as evidence of correctness or as a recommendation to act.

5. No regulatory status

The User acknowledges and agrees that;

  • the Company is not licensed, authorised, or regulated as financial advisers, investment managers, brokers, or any other category of regulated financial services provider in any jurisdiction;
  • the use of the App, its Content, the Services and the Outputs are not and shall not be considered and interpreted are regulated financial advice, a personal recommendation, or a regulated communication under any laws and any jurisdiction;
  • trading activities, regulatory protections, and investor rights and obligations vary by jurisdiction and the User only shall verify and be responsible for the use of the Services and/or the Outputs as well as for the respect of the laws, rules and regulations applied in case of performing trading activities.
  • if the User is in the need of financial advice, the User must seek assistance and advice from authorised professional.

6. Acknowledgments

In addition to all what has been indicated hereinabove, the User acknowledges and agrees that :

  • trading and investing carries a high level of risk and may lead to lost capital/incur losses;
  • the App is only a behavioural coaching tool and does not manage, reduce, or assume any of trading risk;
  • the App cannot, among others, place, modify, or cancel trades;
  • any action and decision is based on the User own risk management processes;
  • confidence, certainty, urgency, or decisiveness in the App/services/Outputs' language does not constitute a recommendation to act and must not be treated as evidence of correctness;
  • the User shall not rely on and/or consider and/or interpret the App, its Content, the Services and the Outputs as financial advice, a personal recommendation, or a regulated communication;
  • any and all trading and investment decisions and their outcomes are sole and exclusive responsibility of the User;
  • the User has read and understood this Risk Disclosure in full.
