PLEASE READ THIS TRANSPARENCY NOTICE CAREFULLY

The use of the App, its Content, the Services and the Outputs (as defined by the Terms and Conditions) requires you as the User (as defined in the Terms and Conditions) to acknowledge and agree the following, which does not replace or limit the Terms and Conditions and/or the Privacy Notice and/or the Risk Disclosure Notice, all of which apply to the User and to the use of the App, its Content, the Services and the Outputs in addition and/or as an integration of the below.

1. The App nature

The User acknowledges and agrees that:

  • the App is a tool using artificial intelligence, the App is not a human coach, therapist, financial adviser, broker, or regulated professional of any kind;
  • the Inputs (as defined in the Terms and Conditions) are processed by an automated AI system and responses/the Outputs are generated automatically;
  • he/she is not speaking with a human at any point, unless the Company explicitly tells otherwise;
  • Use of the App does not create any fiduciary, advisory, brokerage, coaching, therapeutic, or professional-client relationship between the User and the Company.

2. How the App works

The User acknowledges and agrees that:

  • the App is powered by an AI language model;
  • the Services/the Outputs are generated based on the Inputs;
  • over time, the App builds a coaching profile based on the User interactions, which allows the App to provide increasingly personalised support;
  • the User conversation/Inputs are processed by the Company’s AI model provider as a data processor acting on behalf of the Company: details of the current AI model provider are available on request by contacting info@wendyai.bot;
  • the App generates the Services and the Outputs only on the basis of the Inputs and the App has no independent knowledge of trades, positions, or the markets.

3. Coaching profile and data

The User acknowledges and agrees that using the App over time, the App builds a personalised coaching profile based on the User interactions, trading rules, behavioural patterns, and session history. This profile is kept by the App and used solely to improve the quality and relevance of the User coaching experience.

The User can request access to, correction of, or deletion of her/his profile data at any time by contacting the Company at info@wendyai.bot. Please refer to the Privacy Notice for full details of how your data is collected, stored, and used.

4. Use of the App

The User acknowledges and agrees that the App can:

  • help the User to reflect and hold him/her accountable on trading plan;
  • identify emotional patterns such as fear, FOMO, overtrading, or impulsivity;
  • work through User thinking before, during, or after a trade;
  • help in building better habits, routines, and processes of the User as a trader;
  • journal and track User mindset and behaviour over time;
  • develop a long-term coaching relationship based on User personal trading profile.

However, the User acknowledges and agrees that the App is not designed to and shall not be interpretated and considered at any time and for any reason whatsoever to:

  • tell the User what to buy, sell, or trade
  • provide financial, investment, legal, tax, or professional advice
  • replace a licensed financial adviser, broker, or regulated professional
  • predict market movements or guarantee outcomes
  • manage, monitor, or execute trades

Further, the User acknowledges and agrees that any language the App and/or the Services and/or the Outputs use that may appear directional - such as references to holding, closing, entering, or exiting a position - is only a behavioural coaching response based on the Inputs only. Opposite, the App, its Content, the Services and the Outputs are not a financial recommendation, a trading signal, or an instruction to act. The User shall never rely on the App, its Content, the Services and/or the Outputs as your sole source of guidance and shall always apply own independent judgment.

5. App limitations

The User acknowledges and agrees that the App:

  • may misunderstand the Inputs or miss important contexts;
  • the Services and/or the Outputs may be incomplete, inaccurate, misleading, inappropriate, or not suited to a specific situation;
  • Outputs can sound confident but are factually wrong;
  • the App cannot verify facts the Inputs or check the Inputs against external sources;
  • the App may occasionally produce responses that are inconsistent or unexpected;
  • the coaching profile is based entirely on the Inputs and may not reflect your full circumstances.

6. Not an emergency service

The App is not an emergency service. In the event of financial, mental health, or personal crisis, the User shall contact an appropriate professional or emergency service. The App is not equipped to provide crisis support, mental health advice, or urgent intervention of any kind.

7. User responsibility

The User acknowledges and agrees that:

  • the User is solely responsible for every decision made in connection with trading or investing activity;
  • the User is solely responsible for the interpretation of the Services and the Outputs;
  • the use of the App, its Content, the Services and the Outputs does not transfer any responsibility to the Company in any event and for any reason whatsoever;
  • the Company makes no guarantees regarding profitability, trading performance, emotional outcomes, discipline improvement, or financial results arising from use of the App, its Content, the Services and the Ouputs;
  • if the User needs professional financial, legal, or psychological support, the User shall seek advice from an appropriately qualified and experienced professional.

8. Acknowledgment

The User acknowledges and agrees that by using the App:

  • the User is interacting with an artificial intelligence, not a human;
  • the conversation data/the Inputs are processed by a third party AI model provider and that details of the current provider are available on request;
  • the App builds a coaching profile based on the interactions/Inputs provided over time;
  • the App is a coaching tool and not a financial adviser or regulated professional
  • the User shall not rely on the App's responses, Services and Outputs as if the App, the Services and the Outputs are financial advice or professional guidance
  • only the User is solely responsible for trading and investment decisions
  • confidence, certainty, urgency, or decisiveness in the App's language, Services, or Outputs does not constitute a recommendation to act and must not be treated as evidence of correctness
  • the User has read and understood this Notice

9. Access restriction and suspension

The Company reserves the right to restrict, suspend, or terminate access to the App where it is used in a way inconsistent with this Notice, the Terms and Conditions or where the Company determines in its sole discretion that continued access creates legal, compliance, or reputational risk.
